Edge Communications Inc., (“Digital Razor Inc"), owner and operator of the domain www.primarytarget.com, supports the protection of intellectual property and the legal rights of intellectual property owners.  To assist with the protection of those rights, Edge has established the following procedures:

Notice for Claims of Copyright Infringement and Designated Agent for Notice

To file a copyright infringement notification with Edge, a complaining party will need to send a written communication to Edge, by email or by first class mail.  Any email notification should have the words “Copyright Claim” in the subject line.  Any notification sent by first class mail should have the words “Copyright Claim” clearly printed on the envelope. 

To be considered effective, a copyright infringement notification should include substantially the following information (please consult your legal counsel or see Section 512(c)(3) of the Copyright Act to confirm these requirements): 

    1. A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest that has allegedly been infringed;

    2. Identification of the copyrighted work that the complaining party claims has been infringed;

    3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit SCN to locate the material;

    4. Information reasonably sufficient to permit SCN to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the Complaining Party may be contacted;

    5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

    6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is the owner, or is authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.

Such written notice should be sent to Edge’s designated agent as follows:

For copyright claims, upon receipt of appropriate written notification, as described above, from the complaining party or its authorized agent, Edge will remove or disable access to the material that is claimed to be infringing.  To the extent reasonably practicable, Edge shall inform the subscriber or poster that the material has been removed or that access to it has been disabled, and shall provide a copy of the copyright infringement notification.

Please note that under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Counter Notification

If your website or posting has been disabled or removed due to a copyright notification as described above, or if you have received notice of copyright infringement, you may send to Edge a counter notice as described below.  To be effective, a counter notice must be provided in writing to Edge’s designated agent,  by email or by first class mail.  Any email notification should have the words “Copyright Counter Notice” in the subject line.  Any notification sent by first class mail should have the words “Copyright Counter Notice” clearly printed on the envelope.

The counter notice must iinclude substantially the following (please consult your legal counsel or see 17 U.S.C. Section 512(g)(3) to confirm these requirements):

    1. A physical or electronic signature of the subscriber;

    2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;

    3. A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

    4. The subscriber's name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

Upon receipt of a counter notification as described above, Edge shall promptly provide a copy of the Counter Notification to the complaining party, and shall inform the complaining party that Edge will replace the removed material or cease disabling access to it in 10 business days. Edge will replace the removed material and cease disabling access to it in not less than 10, nor more than 14, business days following receipt of the counter notification, unless Edge first receives notice from the complaining party that such complaining party has filed an action seeking a court order to restrain the Infringer from engaging in infringing activity relating to the material on Edge 's system or network.

Please note that under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability. Please also be advised that we enforce a policy that provides for the termination in appropriate circumstances of subscribers who are repeat infringers.
